Expected Learning Outcomes

1. Knowledge and understanding — Students must demonstrate that they know and understand:

  • the essential features of the legal system and the system of sources of law;
  • the constitutional principles concerning the protection of health and the content of the right to health (Art. 32 of the Constitution), in its static and dynamic dimensions;
  • the organisation of the National Health Service (SSN) and of the Regional Health Services (SSR);
  • the legal framework of the nursing profession (from the mansionario to its overcoming; the Bianco-Gelli Law; the Lorenzin Decree);
  • the aspects of civil and criminal liability of the nurse.

2. Applying knowledge and understanding — Students must be able to:

  • recognise and interpret the main institutions of Italian health law;
  • legally frame concrete situations connected with the practice of the nursing profession;
  • identify the rules applicable to the provision of healthcare services;
  • recognise the aspects of liability connected with professional activity.

3. Making judgements — Students must demonstrate that they can:

  • critically assess the legal implications of care activities;
  • recognise the aspects of civil and criminal liability and their consequences;
  • reflect on the ethical and legal implications of their professional choices.

4. Communication skills — Students must be able to:

  • use appropriate legal language in the healthcare field;
  • communicate effectively with the healthcare team on legal-organisational matters;
  • clearly present the main institutions of health law.

5. Learning skills — Students must demonstrate that they can:

  • independently consult legislative sources and institutional documents;
  • keep up to date with developments in healthcare legislation and in the regulation of the nursing profession;
  • integrate legal knowledge into daily professional practice.

Course Structure

The module comprises lectures (Lecture-based Teaching), devoted to presenting the main institutions of health law: the sources of law, the Constitution and the right to health, the organisation of the SSN and the SSR, and the civil and criminal liability of the nurse.

Lectures foster the acquisition of knowledge and understanding of the principles of health law and their relevance to the practice of the nursing profession; case discussion and examples drawn from professional practice help develop the ability to apply knowledge and independent judgement.

If the course is delivered in blended or remote mode, appropriate adjustments may be made to the above, in order to ensure consistency with the syllabus.

Required Prerequisites

No specific prerequisites are required to attend the module. For any formal prerequisites, please refer to the Study Programme's academic regulations. As regards cultural prerequisites, a basic institutional knowledge of the organisation of the State is useful, as it supports the understanding of the sources of law and of the principles addressed in the module.

Attendance of Lessons

Attendance is compulsory. Active participation in lectures is essential to achieve the learning objectives and to understand the main institutions of health law relevant to nursing professional practice.

Learning Assessment

Learning Assessment Procedures

Assessment is carried out through a written test, consisting of a multiple-choice test of 11 questions on the topics of the module. Each correct answer is worth 3 points: ten correct answers correspond to 30/30, while a correct answer to the eleventh question leads to the award of honours (lode).

The test aims to assess knowledge and understanding of the main institutions of Italian health law and the ability to recognise them with reference to the practice of the nursing profession.

During the course, in-course assessments (prove in itinere) and self-assessment tests are envisaged, with a formative purpose, in order to facilitate the progressive learning of the subject and to guide individual study.

As this is a module of an integrated course, the final mark of the course is determined by the average of the marks obtained in the various subjects composing it. Learning assessment is designed in a unitary and integrated manner together with the other modules, according to procedures defined by the coordinator of the integrated course in agreement with the lecturers of the individual modules.

Learning assessment may also be carried out on-line, should the conditions require it.
